The basics

We-Amp B.V., a company registered in the Netherlands (KvK: 57898138), provides ModPageSpeed 2.0 software under a commercial subscription. By activating a license key — whether a trial key or a paid subscription key — you agree to these terms.

Software license

ModPageSpeed 2.0 is distributed under the Business Source License 1.1 (BSL). The BSL governs your right to use the source code. These Terms of Service govern the commercial subscription relationship — billing, support, and operational use. In case of conflict between this document and the BSL, the BSL prevails for source code rights, and these terms prevail for the subscription relationship.

Intellectual property

ModPageSpeed 2.0 and its documentation are owned by We-Amp B.V. Your subscription grants a limited, non-exclusive, non-transferable right to use the software on the number of servers included in your plan. All other rights are reserved.

mod_pagespeed is an open-source project originally developed at Google. ModPageSpeed 2.0 is developed by We-Amp B.V. and is not affiliated with or endorsed by Google.

Your subscription

Subscriptions are available on monthly or annual billing cycles. All billing is handled through FastSpring, our Merchant of Record. You can cancel your subscription at any time through the FastSpring customer portal — no emails to support, no hoops to jump through.

Your subscription grants you an Ed25519-signed license key for the number of servers included in your plan. The license key validates offline — no phone-home, no external requests. The key is for your use only and may not be shared, resold, or transferred to third parties.

Free trial

The 14-day trial is limited to one trial per email address. Trial keys are functionally identical to paid keys — same features, same performance. When the trial expires, the module stops processing new optimizations and passes requests through unmodified.

Payment

FastSpring is our Merchant of Record. They handle all billing, sales tax, VAT, and invoicing on our behalf. Your payment relationship is with FastSpring, and their terms apply to the payment process.

Cancellation & refunds

You can cancel your subscription at any time through the FastSpring customer portal. When you cancel, your subscription remains active until the end of the current billing period. You continue to receive updates and support until then. After the billing period ends, the module stops processing new optimizations and passes requests through unmodified.

Refund requests are handled by FastSpring as Merchant of Record, subject to their refund policy.

Acceptable use

You may not:

• Reverse engineer the license key signing mechanism
• Share, redistribute, or sell license keys
• Use the trial system to obtain multiple trials for the same deployment
• Use the software to attack, disrupt, or overload third-party systems
• Scrape, benchmark, or load-test our website or demo infrastructure without permission

Data processing

ModPageSpeed 2.0 runs entirely on your servers. It does not send data to us. We collect only the data described in our Privacy Policy (email for license delivery, email hash for trial deduplication, IP for rate limiting). We process personal data in accordance with the GDPR. See our Privacy Policy for details on legal bases, retention, and your rights.

Termination

We may suspend or terminate your license if you breach these terms. We will notify you by email and provide 14 days to remedy the breach before termination, except where the breach involves redistribution of license keys or circumvention of the licensing mechanism (immediate termination).

Upon termination, your license key is invalidated and the module stops processing optimizations.

Liability

The software is provided as-is, without warranty of any kind. We do our best to ship reliable software, but we cannot guarantee it will be free of bugs or interruptions. We-Amp B.V.'s total liability is limited to the amount you paid in the preceding 12 months.

Governing law & disputes

These terms are governed by the laws of the Netherlands. Any disputes arising from these terms or your use of ModPageSpeed 2.0 shall be submitted to the competent courts of Amsterdam, the Netherlands.

Changes to these terms

We may update these terms from time to time. Material changes — anything that affects your rights or obligations — will be communicated via email at least 30 days before they take effect. The version identifier at the top of this page will be updated.
